San Jose Criminal Defense Law FAQs
What is an investigative detention?
An investigative detention is when you are temporarily stopped by a law enforcement officer who suspects you of criminal activity. To detain and/or arrest you, the officer must have a good reason (probable cause) to believe you are involved in a criminal act. An investigative detention is illegal if it is based only on profiling by the suspect's race, gender, nervous behavior, and/or presence in the crime area, or curiosity or rumor.
