San Jose Criminal Defense Law FAQs
What are my rights if I am arrested?
The United States Supreme Court ruled that anyone accused of a crime must be informed that they have a to remain silent and that any statement made can be used as evidence against the accused. These "Miranda Rights" also include the right to have an attorney present during questioning, and to have the court appoint an attorney in the event the accused cannot afford one. The accused waive these rights, but only voluntarily and knowingly. Because these warnings do not apply to any volunteered statements, it is important to get an attorney's advice as soon as possible.
